TERMS AND CONDITIONS FOR AFRICAN PHOTOGRAPHY COMPETITION

We thank you for your interest in applying to participate in The African Photography Event. In order to complete your application and qualify to participate, you must accept these terms and conditions. By using our website which is governed by our privacy policy, you accept these terms, conditions, disclaimer in full; accordingly, if you disagree with these terms, conditions and disclaimer or any part thereof, you must not use our website or submit your application and materials.

  1. This Competition and use of this website is intended for use by residents (Natural persons) of all countries, however the pictures submitted must only be of those taken in Africa and unaffiliated with any brand or organisation.
  2. All information detailing how to enter this competition shall be made available on the website of the Photography event.
  3. You acknowledge and agree that the entire content, design, selection and arrangement of the content and material contained in this website, including but not limited to text, software, music, sound, photographs, graphics, video, (collectively and individually, the "Content") is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. You acknowledge and agree that You are permitted to use the Content only as expressly set out below, and any use such as, but not limited to, copying, reproducing, republishing, transmitting, distributing, offering any of the Content to the public, or creating derivative works of the Content is prohibited without the prior express written authorisation of The African Photography Event.
  4. All Content on the Site remains the property of The African Photography Event, or, in respect of certain images, the author of the image.
  5. Information in the Site, including these Terms, is subject to change without notice. Please review these Terms regularly to ensure You are aware of any changes made by The African Photography Event. Your continued use of the Site after changes are posted means You agree to be legally bound by these Terms as updated and/or amended.
  6. The African Photography Event makes no representations that the Content in this Site is appropriate or available for use in all countries. Those who do access this Site are solely responsible for compliance with local laws of the country in which the Content is accessed.
  7. While The African Photography Event will use reasonable efforts to include accurate and up to date information in the Site. The African Photography Event makes no warranties or representations as to the accuracy, correctness, reliability or otherwise with respect to such information, and assumes no liability or responsibility for any omissions or errors (including, without limitation, typographical errors and technical errors) in the Content.
  8. Use of and browsing in the Site is done at Your own risk. Neither The African Photography Event , nor any other party involved in creating, producing, or delivering the Site, nor any naming right sponsors, event sponsors and third parties affiliated with the Photography Event and (“Event Partners”) shall be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of Your access to, or use of, or browsing the Site, or downloading of any materials, data, text images, video, or audio from the Site, including, without limitation, damage to, or viruses that may infect. Your computer equipment or other property as a result thereof. Without limiting the foregoing, everything on the Site is provided to You "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  9. From time to time, The African Photography Event (and its sponsoring companies) may ask that You transmit to the Site by electronic mail Your feedback to the African Photography Organization . Any communication or material You transmit or post will be (a) treated as non-confidential and non-proprietary by The African Photography Event, (b) become the property of The African Photography Event and The African Photography Event shall exclusively now and hereinafter own all rights, title and interest therein, and (c) used without restriction by The African Photography Event or its affiliates or any Event Partners at its sole discretion without any obligation, compensation or other liability to You. Such use may be for any purpose whatsoever, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting whole or in part, in any medium and in any manner on this Site or otherwise. The African Photography Event shall be under no obligation to respond to any such communication.
  10. The African Photography Event reserves the right, in its sole discretion, to disqualify and remove any image uploaded (“entry”) that does not comply with the following requirements, even after the entry is submitted on the Website. You warrant and represent, in respect of each entry submitted by You (“Entry”), as follows:
  11. • You are the sole owner and author of each Entry
    • You have the right to make Your entry available to the site
    • Each Entry does not contain the name or any other identifying information of the entrant (excluding the entrant’s image).
    • Each Entry does not contain any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content.
    • Each Entry which does not contain a short story of the uploaded photo, location and means of capturing the photo,
    • Each Entry does not contain any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability, or otherwise violate any law either of the African Jurisdiction or any other country whose laws may apply to the entry.
    • Each Entry does not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity.
    • Entries which contain any commercial content that promotes any product or service Event.
    • Entries containing screen credits are prohibited.
  12. You agree to fully indemnify The African Photography Event in respect of all royalties, fees and any other monies owing to any person by reason of Your breaching any of the foregoing.
  13. You confirm that each person depicted in the Entry has granted permission to be portrayed as shown. Any costumes, props or other materials used must be rented or borrowed with the permission of the owner, and all other relevant permissions must have been obtained.
  14. If You are under 18, You have Your parent’s or legal guardian’s consent to upload images onto the site.
  15. The African Photography Event may run an online rating process whereby members of the public may vote for a favourite photograph. If there is sufficient evidence (in The African Photography Event sole discretion) to suggest malpractice and manipulation of the rating process, then The African Photography Event has the right to remove the relevant Entry or Entries.
  16. Entry into this Competition is as follows: By email to info@africanphotographyorganization.com Entries must be labelled with the Entrant’s name and location of the photograph. Image files must be minimum of 1000px by 500px and not more than 4MB. Entrants must include their name, address and telephone number or if via Instagram with the use of the hashtag #Africanphotographycompetition2020 Postal entries are not acceptable.
  17. All entries must be received by the 30th of November 2022
  18. All images submitted must be the work of the individual submitting them and must not have won a prize in any other photographic competition. It is the responsibility of each entrant to ensure that any images they submit which include an identifiable person or persons have been taken with the permission of the person or persons pictured and do not infringe the copyright of any third party or any laws. Entrants must warrant that the photograph they are submitting is their own work and that they own the copyright for it.
  19. Copyright in all images submitted for this Competition remains with the respective entrants. However, in consideration of their providing the Competition, each entrant grants a worldwide, irrevocable, perpetual licence to The African Photography Event to feature any or all of the submitted images in any of their publications, their websites and/or in any promotional material connected to this competition.
  20. You acknowledge that it is Your responsibility for protecting any Entry against image misuse by any third party, for example, but not limited to the insertion of a watermark. The African Photography Event and its Partners assume no responsibility and are not liable for any image misuse.
  21. More than one entry per person CAN be made. Late, illegible, incomplete, defaced or corrupt entries will not be accepted. No responsibility can be accepted for lost entries and proof of transmission will not be accepted as proof of receipt.
  22. The winning entry will be that which is adjudged to be the most visually appealing, original, depicting architecture, culture and the hustle and bustle of the African city (any African City). This categories can be revised annually
  23. This Competition is classified based on the different categories of photographers which are:
  24. General Category (Amateur Photographers): This category is open to the general public and they are limited to using only their Mobile phones for taking the pictures. And
  25. Professional Photographers: This category of photographers can use any device to take their pictures e.g. drones, standard professional cameras etc.
  26. There would be prizes for the different categories of photographers (Landscape, People/ Portraits, Food & Drinks, Event/ Weddings, Culture, Architecture)

  28. Winners will be contacted to redeem prizes within a month after notification. The Winners may be required to take part in publicity.
  29. The prizes as described are available on the date of publication. All prizes are non-transferable and there are no cash alternatives to non-cash prizes.
  30. Events may occur that render the Competition itself or the awarding of the prizes impossible due to reasons beyond the control of The African Photography Event and accordingly The African Photography Event may at its absolute discretion vary or amend the Competition and the entrant agrees that no liability shall attach to the Promoter as a result thereof.
  31. This Competition shall be governed by the Laws of the Federal Republic of Nigeria and the exclusive jurisdiction of African Courts shall prevail.
  32. We possess the right to make adjustments to the Terms and Conditions as deemed necessary, for the good of all concerned.
